Third-Party Claim
What Is a Third-Party Claim?
A third-party claim is a claim, loss, or suit filed by someone other than the policyholder.
What Is the Difference Between a Third-Party Claim and a First-Party Claim?
A first-party claim is a claim or loss filed with the insurance company by the policyholder.
For example, if a fire occurs and you file a property claim with your insurance carrier, this would be a first-party claim because it was filed by you, the policyholder.
A third-party claim occurs when someone is hurt due to your negligence and files a claim against you and your insurance carrier.
An example of this would be if a customer tripped over exposed extension cords next to your food trailer and filed a claim with your insurance company to pay for their injuries.
How Does a Third-Party Claim Work?
The third party will contact your insurance company and notify them that they’d like to file a claim against you. They’ll be asked to submit necessary info about the incident, which usually includes:
- Your name and contact information
- Any evidence they have of injury or loss caused by you
- A police report, if necessary
Your insurance company will investigate the claim, just like they would if you filed one yourself, and determine if you are liable to pay for damages.
Will a Third-Party Claim Affect My Insurance?
Depending on the circumstances, a third-party claim can affect your insurance eligibility and premiums. The insurance carrier will look at several factors when it comes to claim activity:
- The number of claims filed
- The size of the claim paid
- What caused the loss
- What measures have been taken to reduce the same kind of loss

Information Required to File a Third-Party Claim
The two required pieces of information we need are the policy number and a description of the incident.
Anyone filing a third-party claim will be asked to fill out a claim form to the best of their ability, which asks for information such as:
- The date and time of loss
- The policyholder’s name and address
- The location of the incident
- The name of the police or fire department that took a report of the incident
